現在先至知道原來銀耳相思鳥是瀕危鳥種，要用黃牌畀自己。

According to the IUCN Red List, Silver-eared Mesia is listed as Least Concern.
跟據國際自然保護聯盟瀕危物種紅色名錄(IUCN紅色名錄), 銀耳相思鳥列為"無危"級別

Instead, it is Yellow-breasted Bunting that should be Endangered.

Hope these birds can be treated in good conditions in captivity.

Not sure whether they are now in KFBG or AFCD detention centre

沙頭角截獲非法進口活生雀鳥

　　漁農自然護理署（漁護署）發言人今日（七月十五日）表示，警方於沙頭角管制站截獲一批162隻沒有健康證明的進口活生雀鳥。

　　昨晚警方截查一架由內地抵港的單車，發現車上有162隻雀鳥，藏於七個籠內，包括14隻白尾藍地鴝、91隻禾花雀、47隻藍歌鴝及10隻屬瀕危物種的銀耳相思鳥。

　　這批來歷不明的雀鳥充公後，已抽取樣本作禽流感測試，並送往漁護署動物管理中心作觀察。

　　一名36歲男子被捕。案件交由漁護署跟進，現正進行調查。

　　根據《公眾生（動物及禽鳥）規例》（第139A章），任何人士進口雀鳥或活家禽，必須附有由出口地禽畜生當局簽發的健康證明，違者可被罰款25,000元，而相關動物亦會被充公。另外，根據《保護瀕危動植物物種條例》（第586章），任何人進口、出口、再出口或管有瀕危動植物，受許可證制度所規管，違反有關附錄II物種的規定，可被罰款50萬元及監禁一年。

　　發言人呼籲市民切勿非法進口沒有健康證明的活生雀鳥或家禽，否則會遭檢控。

　　市民如欲查詢動物入口資料或舉報偷運個案，可致電1823電話中心。

The information presented in the report is a bit confusing.
該報告所表達的資訊容易引起混淆。

The statuses of the bird presented in the report makes reference to Protection of Endangered Species of Animals and Plants Ordinance (Cap. 586).
This ordinance gives effect to the Convention on International Trade in Endangered Species (CITES) of Wild Fauna and Flora, by regulating the trade and possession of certain endangered birds.  
報告所述的鳥種級別乃源自香港法例第586章《 保護瀕危動植物物種條例》，本條例旨在施行《瀕臨絕種野生動植物國際貿易公約》，規管某些瀕危鳥類物種的交易和管有。

Silver-eared Mesia is listed under Appendix 2 under Cap. 586.  Species listed in Appendix 2 are not necessarily threatened with extinction, but trade must be controlled in order to impacting on their natural population significantly.
銀耳相思鳥為列入第586章附錄2的鳥種，而附錄2所列明的物種不一定是受絕滅威脅的，但卻要控制這些物種的買賣以避免影響其天然群族的繁衍。

Yellow-breasted Bunting, White-tailed Robins and Siberian Blue Robins on the other hand are not protected under Cap.586.
黃胸鵐(禾花雀)、白尾藍地鴝及藍歌鴝均不受《保護瀕危動植物物種條例》保護。

This is perhaps an area in which conservationists may contribute.  
It seems that the confusion is due to different usage of the word "endangered" by two entities, the CITES (which protects species from over-exploitation through international trade, and which forms the backbone of Hong Kong Law Cap 586) and the IUCN (which produces and maintains the Red List of Threatened Species, which "is widely recognized as the most comprehensive, objective global approach for evaluating the conservation status of plant and animal species"), and apparantly there is lack of communication between these two entities.
However, I notice from AFCD website that AFCD (or HKSAR Government) can initiate amendments to CITES Appendices I, II and III.  Perhaps conservationists of Hong Kong can discuss with AFCD so that the Red List species relevant to Hong Kong can be appropriately incorporated in CITES, and accordingly enacted under Cap 586.  However, please note that both CITES and Cap 586 only focus on prevention of over-exploitation through trade (import, export etc).  In the longer term, perhaps more should be done to effectively prevent the endangered species from extinction.
