I think you'll find this to be a female Black-faced Bunting. Chestnut-eared would show rufous shoulders, a black necklace contrasting with ground color of the pale breast, and at least a trace of chestnut on the ears. The indistinct facial pattern, plain rump and the crest points to Black-faced. I like the photos though!
