Greater Spotted Eagle?

An eagle was seen flying in Maipo with long broad wings with 5-6 fingers and rather short tail. Underside is brown without too much features, except the area around the feet is slightly shallower in colour. Head looked very slightly paler than the body. My first thought - maybe an Imperial Eagle.
 
Then another eagle was seen perching (see photo). Whole bird is dark brown on scope without any spot. Yellow beak and base extending below eye. Unfornately it was quite hazzy and only one digiscope photo was taken before all battery died
 
Are both actually a greater spotted eagle?

This bird is certainly Greater Sotted Eagle.
 
Thother bird is harder to tell fromjust a description, and eagles may need some care to separate.

For the flying eagle, actually my first thought was a black vulture because the wing is really long and broad while the tail is round and short (we've seen quite a few in America). Wings flapped only occasionally for a few beats. However, the head indicates that it is definitely an eagle and not a vulture. As we have not seen any spotted eagle before so we can think of only imperial eagle. But after we spotted the perching eagle and reviewing several books, it seems the descripture best  fit a greater spotted eagle.
 
Anyway this would be a good tick for me and my wife.
